For the second year in a row, the New York State Legislature passed the “Wrongful Death Act,” which expands the list of people who are eligible to sue in alleged wrongful death cases and allows individuals to sue for undefined emotional damages. However well-intentioned, this legislation will cause insurance premiums to rise so steeply that it will be impossible for many independent healthcare practitioners and other small businesses to keep their doors open.

Wrongful deaths are tragic, and anyone who has lost a family member in a preventable accident deserves restitution. In New York, strong protections are already in place to make sure that family members receive fair and just compensation – In fact, the state of New York already has the highest medical malpractice awards in the country.

This bill will harm health practitioners and small businesses — in particular,
those that provide vital services to the Asian-American community.

Skyrocketing Insurance Costs

The wrongful death bill will cause insurance costs to rise dramatically, hurting families and small businesses across the state. Analysis by Milliman, Inc. predicts a 12.6% increase in annual premiums for both businesses and individuals.

Those increased costs will affect everyone. Small businesses will face new costs that will be passed down to consumers. Patients and their families will face even higher healthcare costs. Taxpayers will suffer as municipal governments with large workforces will have to pay much higher insurance premiums. Independent practitioners are already under tremendous financial and emotional pressure. This legislation will only add to that burden.

 

Harm to Asian-American Community

The majority of New York’s Asian-American community are first and second-generation immigrants. Many of them rely on independent health practitioners who share their common language and culture, as well as small businesses that offer recent immigrants and their children a reliable pathway to the middle class.

The Wrongful Death Act will prompt a sharp increase in insurance costs that will dramatically raise the cost of living for Asian-American healthcare providers, small businesses, patients, and consumers.

This bill will force our community members to seek care and services from deep-pocketed corporations and healthcare conglomerates who will not give them the individualized, culturally competent support they need.

 

No Fiscal Analysis

The proposed legislation is an updated version of a similar 2022 bill that Governor Hochul vetoed earlier this year. In an op-ed explaining her thinking, Hochul argued that the state lacked “a serious evaluation of these massive changes on the economy, small businesses, individuals, and the state’s complex health care system.” To date, the state of New York has still done no fiscal analysis of this legislation. Nobody – not the bill’s authors, the governor, nor the businesses that will be affected – have a full understanding of how much the bill will cost.

The Wrongful Death bill, though well-intentioned, will bring New York into an unpredictable new era of rising insurance costs.

We, the undersigned, are health care providers, small business owners, community leaders, patients and consumers from New York’s Asian-American community. As representatives of the fastest-growing demographic in our state, we are deeply concerned about the potential damage the “Wrongful Death Act” could do to our community.

During your time as Governor, you have shown unprecedented leadership in delivering resources to support the vast network of community-based organizations that serve New York’s Asian-American population, and have stood with us against a rise in hate crimes and as the economic and public health toll the COVID-19 pandemic has wreaked on our small businesses and health care providers.

We ask you to continue to lead and reject legislation that will dramatically increase insurance premiums for independent medical practitioners, restaurants, and other small businesses our community relies on.

 

Governor Hochul, we urge you to VETO the Wrongful Death Act!
